Reading this again I became rather puzzled about what you really
want to do -- perhaps the best choice is to have  rsync  parameter:
  --exclude  CVSROOT/config
in your rsync script ?

Is that exclusion pattern the best possible, I am not sure, but
it should work (as I read the manual's explanation.)
